This is an action brought by George Both, the plaintiff, against Joseph Fleck, the defendant, to recover the cost of repairing the plaintiff’s automobile which the plaintiff alleges was damaged by being struck by the automobile of the defendant.

The case was tried before the court without a jury. The court found in favor of the plaintiff, and assessed the plaintiff’s damages at $422.38. From the judgment on the finding the defendant has prosecuted this appeal.
