MEMORANDUM OPINION

REBECCA BEACH SMITH, District Judge.

This matter comes before the court on several outstanding motions from each of the parties. On April 16, 2010, defendant Lawrence T. Peter (“Peter”) filed a Motion to Drop defendant Col. John J. Holly (“Holly”) from this litigation, claiming the court lacked personal jurisdiction over Holly and the claims against Holly are time-barred.
