MEMORANDUM OPINION AND ORDER

This matter comes before the court on several outstanding motions from each of the parties. On May 12, 2011, defendant the United States of America (“United States”) filed a Motion to Dismiss for lack of subject matter jurisdiction, claiming that the plaintiff, Richard John Charles Galustian (“Galustian”), failed to file an administrative claim as required by 28 U.S.C. § 2675.
