The parties have stipulated that only questions of law are involved in this proceeding.

On March 17,1932, relator was convicted in the Kings County Court of the' crime of robbery in the second degree. He was thereupon examined as to his mental condition and it was determined that he was a mentally defective person and thereupon the court committed him to the institution for male defective delinquents at Napanoch, New York.
