ORDER

KENT, District Judge.

Plaintiffs bring this action under 42 U.S.C. § 1983 against the City of Houston, alleging violations of due process and equal protection under the Fifth, Eighth, and Fourteenth Amendments to the Constitution, as well as pendent state claims under the Texas Tort Claims Act (“TTCA”), Tex.Civ.Prac. & Rem. Code §§ 101.001-101.109 et seq. Now before the Court is Defendant’s Motion to Dismiss, filed October 30,1997. For the reasons stated below, the Motion to Dismiss is GRANTED IN PART and DENIED IN PART.
