This cause is now before this court following remand from the Supreme Court of the United States.

On August 5, 1966, a complaint was filed in the Ju venile Court of Fairfield County alleging that Buddy Lynn Whittington, a minor of the age of 14 years, appeared to be a delinquent child in that he did, on or about July 29, 1966, in the village of Baltimore, county of Fairfield, state of Ohio, unlawfully, purposely and maliciously kill Gladys Willard, contrary to Section 2901.05 of the Eevised Code.
