Judgment unanimously affirmed. Memorandum: Defendant was convicted following a jury trial of sexual abuse in the first degree (count *763seven) (Penal Law § 130.65 [1]), sexual abuse in the second degree (count eight) (Penal Law § 130.60 [2]) and endangering the welfare of a child (count nine) (Penal Law § 260.10 [1]). Those charges arose from an incident on September 15, 1996 involving a 12-year-old victim. Defendant was acquitted of six other counts.
