The appellant contends that the court below committed error in allowing the defendant Sutton’s motion for judgment as of nonsuit. The evidence at the trial tended to show the following facts: In 1962 Tugwell and Wood organized a partnership to engage in the business of trucking and hauling grain. In 1964 the partnership was incorporated with the original shareholders of stock being Tugwell, Wood and Joyce Tugwell, sister of Wood.
