PRETTYMAN, Senior Circuit Judge.
In a criminal case in the United States District Court the appellant Peerless Casualty Company executed a bail bond to secure the appearance of the defendant in court. The bond was in the form contained in the Appendix of Forms (Form 17) to the Federal Rules of Criminal Procedure. The defendant failed to appear. The United States, pursuant to Rule 46(f) (1) of the Criminal Rules and to the terms of the bond, on December 3, 1954, moved the District Court to declare a forfeiture of the recognizance.
