— Appeal by the People from an order of the Supreme Court, Queens County (Clabby, J.), dated August 2, 1983, which granted that branch of defendant’s motion which sought dismissal of the indictment on the ground that he was denied a speedy trial (People v Buckmon, 120 Misc 2d 355).

Order reversed, on the law, the aforenoted branch of defendant’s motion denied, indictment reinstated, and matter remitted to the Supreme Court, Queens County, for further proceedings.
