— In an action to recover damages for fraud, the third-party defendants appeal from an order of the Supreme Court, Nassau County (Becker, J.), dated December 1, 1988, which denied their cross motion for summary judgment dismissing the complaint and third-party complaint, and the defendant and third-party plaintiff Dan’s Supreme Supermarket, Inc. cross-appeals from so much of the same order as denied its motion for summary judgment dismissing the complaint.

Ordered that the order is reversed, on the law, the motion and cross motion are granted, and the complaint and the third-party complaint…
