This is an appeal by Albert M. Zakoura, who was convicted and sentenced to hang for the murder of his wife in the city of Paola on Sunday morning, December 1, 1935.

*805Before considering the errors urged against the judgment, it will be helpful to an understanding of the case to state certain facts antecedent to the tragedy which are contained in the record.
