OPINION ON APPELLANTS PETITION FOR DISCRETIONARY REVIEW

MALONEY, Judge.

After a jury convicted appellant of the felony offense of credit card abuse under TexJPenal Code Ann. § 82.81(b)(2), the trial judge sentenced him to ten years in prison, probated for ten years, and imposed a $2,000 fine. Upon direct appeal, the First Court of Appeals affirmed appellant’s conviction and sentence with one justice dissenting. Olurebi v. State, 818 S.W.2d 851 (Tex.App.—Houston [1st Dist.] 1991).
