In response to an Application of Debtor in Possession to Sell Property, Warren Higa, (hereafter “Higa”) acting pro se as a shareholder of the debtor corporation, filed a Memorandum Re: Invalidity of May 4, 1985 Board Action, challenging the validity of the election of the members of the Board of Directors and the resultant authority of this Board to file the instant Chapter 11 case.
