Re argument of appeals by John Bales and George Ringler & Company from an order of the Supreme Court, made at the Westchester Special Term and entered in the office of the clerk of the county of Westchester on the 2d day of October, 1911, revoking and • canceling liquor tax certificate No. 12,918, issued to said John Bales, and also from a judgment entered in said clerk’s office on the llth day of October, 1911, pursuant to said order. Burr, J.:

On September 23, 1909, a certificate was issued to one William Simmons for traffic in liquor upon premises on Dock street, in the village of Hastings, for the excise year ending September 30, 1910. This certificate was transferred on June 30, 1910, to John Bales, who had obtained a lease of said premises for five years from July 1, 1910, and who thereupon entered into and has since continued in the possession thereof. *284At the time of the transfer of such certificate to him he executed and delivered to the Manilla Anchor Brewing Company an instrument under seal, and reciting a valuable…
