SWINFORD, District Judge.
This is an action for injunctive relief under the Kentucky Fair Trade Act of 1936, KRS 365.080, 365.090. The Act provides as follows:
“365.080 (4748Í-1; 4748Í-3) Resale price of commodities may be regulated by contract; conditions implied. (1) No contract relating to the sale or resale of a commodity that bears, or the label or content of which bears, the trade-mark, brand or name of the producer or' owner of the commodity and that is in fair and open competition with commodities of the same general class produced by others shall be deemed in violation of any law of…
