William H. Cox sued the Western Gravel Road Company for work and labor done by him for the defendant, under a written contract, in the construction of a portion of her road.
The defendant pleaded a counter claim, alleging that by the contract between the parties> the work was to have been completed within a specified time, and that the plaintiff failed *261to complete the same within the' time specified.
