BACKGROUND

Appellant Daniel Thompson was arrested on August 29, 1997 and charged with conspiring to distribute 500 grams or more of cocaine in violation of 21 U.S.C. § 846. Thompson retained Rudy Velez as counsel. The government offered Thompson a plea agreement, dated February 11, 1998 (“First Agreement”), which he rejected. Subsequently, however, the government offered a second plea agreement, dated June 16, 1998 (“Second Agreement”), which Thompson accepted.
