The case made in the complaint is substantially as follows: Mrs. Lewis was the owner in fee of a house and lot in Mineral Point, which she desired to sell; and for many years Mr. Henry Rad been ber special agent in respect to the property, and -was authorized by her to find a purchaser for it, and to submit to her, by letter or otherwise, such offers as he might receive. This court has no power to amend, the record as it is returned here from the court below. It can, on proper suggestion, order a further return, or remit the record for correction, and enforce its orders. But the court below alone possesses power to add to or take from the record.
