Suit by Gertrude Lyon against Dr. Scholl’s Foot Comfort Shops, Inc., a corporation, and Dr. F. F. Martin to recover damages for injuries sustained by plaintiff when she slipped and fell on one of the floors in defendants’ store. At the close of plaintiff’s testimony, the court granted a motion for a directed verdict in favor of Dr. Martin on the ground that there was no evidence that he had any control over the premises and on the ground that he was not guilty of any actionable negligence.
