Appeal from a judgment of the Supreme Court at Trial Term (Smyk, J.), rendered November 19, 1981 in Chemung County, upon a verdict convicting defendant of the crimes of attempted murder in the second degree and assault in the first degree. The charges against defendant arise out of an incident which occurred at about 1:40 a.m. July 25,1981, in a parking lot outside of the Inside New York Bar in Elmira Heights, New York.
