— Appeal from a judgment of the County Court of Broome County (Monserrate, J.), rendered September 16, 1983, upon a verdict convicting defendant of the crimes of attempted rape in the first degree and endangering the welfare of a child.

It is alleged that on March 18, 1983, defendant and several companions engaged in sexual intercourse with the 14-year-old female complainant. Defendant was indicted on one count of rape in the first degree and one count of endangering the welfare of a child.
