This is an action of contract or tort which was tried to a jury. At the conclusion of the evidence the defendant filed a motion for a directed verdict; this was denied, subject to the defendant’s exception. The jury *388returned a verdict for the defendant on the first count, and for the plaintiff on the second count, of her declaration. Before recording the verdict on the second count the judge reserved leave with the assent of the jury (G. L. [Ter.
