MOSCOWITZ, District Judge.

This case was tried by the court without a jury, jury trial having been waived. The government seeks to recover judgment against the defendant Louis Fiedler, as principal, and the defendant Detroit Fidelity and Surety Company, as surety, oü a bond in the sum of $5,000.

On June 26, 1925, the government filed a libel in this court for the forfeiture of the motorboat Pal for violation of section 26 of title 2 of the.National Prohibition Act (27 USCA § 40), and for violations of the Customs and Revenue Statutes, by virtue of the seizure of said vessel on April 4, 1925.
