KENNERLY, District Judge.

This is an action at law by the United States of America against John C. Bryan, as principal, and Carl Glaser and L. J. Rung, as sureties, on a bond for $70, executed by them November 10, 1932, to the United States, under the following circumstances:

John C. Bryan (the principal) and one Lockey L. Foyt were arrested by prohibition officers on or about November 8, 1932, charged with possessing and transporting intoxicating liquor in a 1926 model Dodge sedan, owned and driven by Bryan. Foyt had intoxicating liquor in his possession in the ear, hut Bryan had no knowledge…
