Appeal from District Courts Major County; James B. Cullison, Jiidge. Peter F. Duerksen was tried in the district court of Major county on., a charge of embezzlement, and was acquitted by the jury on advice of the trial court.

This is an appeal by the state on a question reserved, growing out of a judgment of acquittal entered in the district court Of Major county by direction of the trial court in a case wherein the state of Oklahoma prosecuted Peter F. Duerksen on a charge of embezzlement. The charging part of the information upon which the prosecution was based is as follows:
