On 12 January 1998, Howard Eugene Safrit (“defendant”) was indicted on one count of assault with a deadly weapon with intent to kill inflicting serious injury (“97 CRS 15635”), and one count of robbery with a dangerous weapon (“97 CRS 15636”), arising from an altercation with Tyrone Miller that occurred in the early morning hours of 15 November 1997.
