The plaintiff in error, hereinafter called defendant, was convicted in the county court of Beckham county on a charge of criminal libel and sentenced to serve a term of one year in the county jail. From the record, we gather that in May, 1923, the defendant procured one Janie Duncan and her husband, W. P. Duncan, to go before a notary public, and he there dictated and had written an affidavit charging various persons with having had intercourse with said Janie Duncan without the consent of her husband.
