Plaintiff in error, Leo Fry, defendant below, was charged by information in the district court of Latimer county, Okla., with the crime of the murder of Lawrence Riley on March 23, 1947. The defendant was tried, and convicted by a jury of first degree manslaughter, which fixed his punishment at 25 years in the State Penitentiary, and judgment and sentence was entered accordingly. From said judgment and sentence, this appeal has been perfected.
