ERROR to review a judgment of the circuit court for Yernon county: O. B. Wyman, Circuit Judge.

The plaintiff in error was convicted of mnrder in the second degree, for having hilled Asa Gorham,. January 25,1897. He was charged with murder in the first degree. The defense was justifiable homicide.

There is evidence tending to prove that Gorham and Sullivan, were neighbors and lived some twenty-four rods apart; that a difficulty had arisen between them by reason of the alleged improper relations existing between Gorham’s wife and Sullivan, who was an unmarried man, living alone in a house; that ten days previously Gorham had abandoned his wife, and was living in a house a short distance…
