ERROR to review a judgment of tbe circuit court for Mani-towoc county: Michael KirwaN, Circuit Judge. Plaintiff in error was, in due form, charged with having May 12, 1912, at Eranklin, Manitowoc county, Wisconsin, murdered John Eoliand. He entered a plea of not guilty and was tried and convicted of murder in the second degree. Judgment was rendered accordingly.

These facts appear from the evidence without dispute: The accused, a man about fifty years of age at the time of the homicide, resided on a farm. An old lady, a relative of his deceased wife, was his housekeeper. John Eoliand, whom the accused had known for several years, resided with him. Eoliand was of a somewhat quarrelsome disposition.
