Pugh, against the peace and dignity of the state of Wisconsin.”

To determine the question whether a new trial ought to have been allowed on the motion of the defendant, on the evidence or the- merits of the case, and in order to make the exceptions to the charge given and the instructions refused intelligible, a concise statement of the material facts becomes necessary.
