MEMORANDUM OPINION
SUE L. ROBINSON, District Judge.
I. INTRODUCTION
This is an appeal from a final order of the Bankruptcy Court for the District of Delaware entered on October 31, 1991. The Court’s jurisdiction to entertain this appeal is based on 28 U.S.C. § 158(a) and Bankruptcy Rule 8001(a).
The facts relevant to this appeal are not in dispute. Chatios Systems, Inc. (“Chat-los”), the-debtor-in-possession, was the tenant under a lease agreement (“the Lease”) with Elbert A. Kaplan (“Kaplan”) for nonresidential premises commonly known as 125 Algonquin Parkway, Whippany, New Jersey (“the…
