BELL, Chief Justice.
This is an appeal by Allstate from a judgment sustaining a motion for summary judgment in favor of Roscoe Clarke and in overruling a summary judgment motion filed by appellant.
The controversy is over the sum of $9,-500.00 which is a part of the judgment recovered in a suit by Clarke, in which appellant had intervened, against C. T. Hilliard, Jr. and Hilliard Funeral Home. The recovery was for damages resulting from injuries suffered by Clarke personally as the result of an automobile accident.
