SMITH, J..Separate actions were brought -by two brothers against the administratrix of their mother’s estate and others, for the purpose of quieting title to separate parcels of 'real property. These parcels of real property came to the respective brothers through contemporaneous transactions carried on with their mother wherein the real property was conveyed to the brothers in consideration of their separate promises to make certain payments to their mother.
