By order of court the above-entitled cases were, on the hearing of the appeals, consolidated, and for convenience the parties will be referred to as designated in the court below.

Plaintiff brought this action against the defendants for a breach of contract, alleging in his complaint, inter alia, that they entered into a contract with him at Fallon, Nevada, on the 8th day of September, 1924, by which they sold and agreed to deliver to him on or before October 1, 1924, 1,200 head of ewe sheep at $7.50 per head, or a total price of $9,000, 800 head of said sheep to…
