FINDINGS, RULINGS AND ORDER

This is a civil action brought pursuant to G.L. c. 152, §66. Plaintiffs are seeking recovery for the death of Nicholas C. Roumeliotis. Defendants contend that Nicholas C. ^Roumeliotis was not an employee at the time of his death, his death did not arise out of or in the course of his employment, and that the plaintiffs are not the proper parties to this suit. This case was heard by the court, sitting without a jury, on May 7, 27 and 28, 1980.
