Defendant/Appellant David Espinoza was convicted of possessing with' intent to distribute more than one hundred kilograms of marijuana in violation of 21 U.S.C. § 841(a) and was sentenced to a term of 60 months’ imprisonment to be followed by five years’ supervised release. He now appeals his conviction on the ground that his right to a fair trial was violated. Specifically, Mr. Espinoza argues that the trial judge erred by: (1) improperly giving the jury a “deliberate ignorance” instruction though there was no evidence that he had engaged in deliberate acts to avoid gaining actual knowledge…
