The action is to recover damages for the death of one Frederick Christman, alleged to have been caused by the negligence of the defendant.
The facts adduced upon the trial are that Frederick Christman, an employee of the Oakes Manufacturing Company, which was *782engaged in the business of manufacturing dyes, met his death on the 17th day of October, 1916, in a fire which destroyed one of the company’s buildings at Astoria, L.
