This is an appeal from a judgment of the district court of Oklahoma county in favor of the defendant in error, hereinafter referred to as the plaintiff, against the plaintiff in error, hereinafter referred to as the defendant. The action was based on a claim of damages sustained by the plaintiff by reason of an injury arising from the alleged negligence and carelessness of one Ray MeCallon, who was alleged by the plaintiff to have been the agent, servant, and employee of the defendant at the time of the injury.
