KAHN, District Judge.
This action was brought by Plaintiff Melvyn Bentley (“Bentley”) in Bankruptcy Court for the Northern District of New York. It arises out of Bentley’s unsuccessful attempts to obtain an Emergency Loan from the Defendants, first acting through his wholly-owned corporation, An-naquasicook Farm, Inc. (“AFI”) and later seeking to proceed with the application as an individual.
