Jones moved in the County Court against Blake B. Woodson and John Raine, for an award of execution on a delivery bond. Notice to both was proved; but Wood-son did not appear. , Raine appeared, and pleaded non est factum,, and a jury were instanter sworn. Henry ' Jl. Ligón was the deputy sheriff who took the bond, and was examined by the plaintiff as a witness.
