MEMORANDUM AND ORDER

BRODERICK, District Judge.

This matter comes before the Court on the defendants’ motions for a new trial or, in the alternative, for a judgment of acquittal. The three defendants were jointly tried and were convicted by a jury as charged in the indictment.

All the defendants in this ease were charged in Count No. I of the three-count indictment with conspiracy to possess with intent to distribute marijuana in violation of 21 U.S.C. §§ 841(a)(1) and 846.
