The Court previously granted plaintiffs first motion for summary judgment with respect to Count One, which resulted in a remand to the Secretary of the Army, and dismissed the other two counts of the complaint. See Mudd v. Caldera, 26 F.Supp.2d 113 (D.D.C.1998). After the Secretary’s decision on remand, this case is back before the Court on plaintiffs second motion for summary judgment and defendants’ cross-motion to dismiss or, in the alternative, for summary judgment.
