Defendants-appellants the County of Nassau and the Sheriff of Nassau County (“Nassau County”) appeal from a judgment of the United States District Court for the Eastern District of New York (Frederic Block, District Judge) denying their motions for judgment as a matter of law pursuant to Fed.R.Civ.P. 50(b) and for a new trial pursuant to Fed.R.Civ.P. 59(b). Although not explicitly argued by Nassau County, we construe Nassau County’s ap*601peal as a challenge to the district court’s denial of its Rule 59(b) motion for a new trial.
