People v. Love

On February 2, 1984, defendant pled nolo contendere to a charge of burning real property, MCL 750.73; MSA 28.268, in exchange for dismissal of two other charges and a supplemental information. On March 7, 1984, he was sentenced to a term of from five and one-half to ten years’ imprisonment. On appeal, defendant raises issues related to the sentencing guidelines.

The sentencing information report prepared for defendant reflects a prior record level of "F” and an offense severity level of "HI”. Defense counsel objected to the scoring of the prior record level for reasons conceded to be erroneous…
