There is nothing in the plain language of K.S.A. 21-5430(b) that limits the criminal liability for a death resulting from using a controlled substance to the final distributor of the controlled substance. Instead, liability extends to anyone who had joint control of the controlled substance. 2. Distribution of fentanyl is a crime under K.S.A. 21-5705(a)(1) and by extension distribution of fentanyl causing death is a crime under K.S.A. 21-5430(b).…
