BEAM, Circuit Judge.
Chuck Mathenia, under sentence of death, appeals the district court’s1 denial of his request for relief under Rule 59(e) of the Federal Rules of Civil Procedure. We affirm.
I. BACKGROUND
This case is before us for a second time. Mathenia v. Delo, 975 F.2d 444 (8th Cir.1992), cert. denied, 507 U.S. 995, 113 S.Ct. 1609, 123 L.Ed.2d 170 (1993).
