Appellant brought this action against respondent railroad company to recover damages for injuries to person and property sustained by him when he drove his automobile into the side of a freight train left standing on a street crossing in the city of Spokane. The case was tried before a court and jury. At the close of appellant’s case, respondent moved the court for an order dismissing appellant’s action, and this'motion was granted.
