The defendant, John Billups, was convicted of the crime of selling intoxicating liquors in violation of the local option law, and he appeals from the judgment rendered on the verdict.

His counsel maintain that an error was committed in overruling a demurrer to the indictment, interposed on the ground inter alia that it did not state facts sufficient to constitute the commission of a crime.
